  • All items sourced through the platform, whether by independent merchants or Again Claimed Inc., are second-hand and may exhibit wear and tear, defects, or other conditions inherent to previously owned goods.
  • The Company makes no guarantees regarding the availability, authenticity, functionality, or condition of items, except as explicitly stated in any item descriptions provided by Again Claimed Inc.

3. Merchant Responsibilities

  • Merchants, including Again Claimed Inc., act on behalf of Buyers to source and acquire second-hand items based on the Buyers’ declarations of intent.
  • Again Claimed Inc. and independent merchants are responsible for providing accurate descriptions of sourced items, including known defects or conditions, to Buyers.

4. Transactions Between Buyers and Merchants

  • When items are sourced by independent merchants, all transactions, including payments, item condition, and delivery, are conducted directly between Buyers and Merchants. Again Claimed Inc. is not a party to these transactions and bears no responsibility for disputes arising from them.
  • When Again Claimed Inc. acts as the merchant, the transaction is conducted directly with the Company. Again Claimed Inc. assumes responsibility for providing accurate descriptions and fulfilling delivery of items.

5. Limitation of Liability

  • To the fullest extent permitted by law, Again Claimed Inc. disclaims all liability for:
    • Losses, damages, or disputes arising from transactions conducted with independent merchants.
    • Delays, errors, or interruptions in the platform's functionality.
    • Indirect, incidental, or consequential damages related to the use of our services.
  • When Again Claimed Inc. acts as a merchant, its liability is limited to the value of the item purchased, excluding any indirect or consequential damages.
