1. Introduction

ACI is a platform that connects buyers with merchants to facilitate the acquisition of second-hand items. The merchant acquires items upon a declaration of intent by the buyer and is commissioned to seek and purchase such items on behalf of the buyer.

2. Definitions

  • Platform: The website, mobile app, or other services operated by ACI.
  • Buyer: A user who declares intent to purchase a specific second-hand item through the Platform.
  • Merchant: An individual or business that is commissioned by the Buyer to source and acquire the requested item.
  • Item: A second-hand good requested by the Buyer.

3. Scope of Services

  1. Buyer Declaration of Intent:

    • Buyers declare their intent to purchase specific second-hand items through the Platform.
    • Buyers are responsible for providing clear and accurate descriptions of the desired item.

  2. Merchant Commission:

    • Merchants act as independent contractors commissioned to locate and acquire the requested item.
    • Merchants do not represent the Platform and are solely responsible for sourcing items in good faith.

  3. Item Sourcing:

    • Merchants will make reasonable efforts to source the requested items as described by the Buyer.
    • Availability, condition, and price of second-hand items are subject to market variability.

4. Fees and Payments

  1. Commission Fee:

    • Merchants may charge a commission fee for their sourcing services. This fee will be disclosed to the Buyer before the purchase is finalized.

  2. Payments:

    • Buyers are required to pay the agreed price for the item and any applicable fees before the merchant completes the purchase.
    • All payments must be processed through the Platform’s approved payment methods.

5. Item Condition and Liability

  1. Item Condition:

    • All items are second-hand and may exhibit wear and tear.
    • The Platform and Merchants provide no guarantees on the condition, authenticity, or functionality of items unless explicitly stated.

  2. Liability:

    • The Platform acts solely as a facilitator and is not responsible for the actions of Buyers or Merchants.
    • Any disputes regarding item condition, delivery, or payment must be resolved directly between the Buyer and Merchant.

6. Prohibited Activities

Users of the Platform must not:

  • Misrepresent the condition or intent of transactions.
  • Engage in fraudulent or illegal activities.
  • Use the Platform for purposes outside its intended function.

7. Termination

The Platform reserves the right to suspend or terminate access to users who violate these Terms of Use.

8. Dispute Resolution

  1. Between Buyer and Merchant:

    • Buyers and Merchants are encouraged to resolve disputes directly.
    • The Platform may provide mediation at its discretion but does not assume liability.

  2. Binding Arbitration:

    • Any unresolved disputes between users and the Platform will be subject to binding arbitration under the laws of [Jurisdiction].

9. Modifications to Terms

The Platform reserves the right to modify these Terms of Use at any time. Changes will take effect upon posting.
